Users have the option to extend usage by connecting their own OpenAI API key to manage additional data access directly. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.5 Use of the App

The App provides educational and informational content regarding OMT, posture, airway health, and related subjects. The information provided is intended for educational and professional development purposes only. It is not a substitute for evaluation, diagnosis, or treatment by a trained medical professional. Users should consult a qualified healthcare provider for medical concerns related to Orofacial Myofunctional Therapy and related conditions. You agree not to use the App for any unlawful or unauthorized purpose. You understand that while we strive for accuracy, the App may contain inaccuracies or typographical errors, and we make no guarantee as to the reliability or completeness of any information.

These principles include AMA Policies H-480.940, H-480.939, and H-480.935, which establish ethical, safe, and equitable standards for the design, development, and use of AI in health care. MYOPHYSX, LLC. is committed to advancing the responsible use of AI in a way that enhances human intelligence, supports the patient-physician relationship, and protects privacy and data integrity. MYOPHYSX, LLC. designs features and pricing to remain accessible to small practices, individual clinicians, and educational users, supporting equitable access and affordability in alignment with AMA guidance.

5.2 Purpose and Scope
MYOPHYSX AI systems are intended to support clinical decision-making, professional education, and workflow organization. They are not intended to diagnose, treat, or replace the judgment of qualified health care providers. All users, including clinicians and organizations, remain responsible for verifying the appropriateness and accuracy of any AI-generated information. Any future AI features intended for clinical decision support will require documented clinical validation, usability evaluation with physicians, and clear labeling prior to release.

5.3 Risk-Based Oversight and Professional Responsibility
Consistent with AMA Policy H-480.939, oversight of AI systems must be based on their level of risk and intended use. Users are responsible for interpreting AI-assisted results within the scope of professional judgment and applicable standards of care. MYOPHYSX, LLC. assumes no liability for misuse, over-reliance, or independent application of AI outputs without professional supervision. Nothing in these Terms restricts good-faith reporting of software defects, safety concerns, or adverse events to MYOPHYSX, LLC., regulators, or affected users.

5.4 Transparency and Disclosure
In accordance with AMA Policy H-480.940, MYOPHYSX, LLC. provides transparency regarding the use of augmented intelligence within its platform. When AI features are active, users will be informed of their purpose and limitations. Users agree to disclose to patients or end users, when applicable, that AI-assisted tools are being utilized for educational or analytical purposes. MYOPHYSX, LLC. maintains an online “AI Disclosures” page describing intended uses, known limitations, training and validation methods, populations used for evaluation, and material updates to AI systems.

5.5 Data Privacy and Security
MYOPHYSX, LLC. adheres to the AMA Privacy Principles and complies with applicable privacy laws including HIPAA and GDPR where applicable. The Company employs data minimization, encryption, and security safeguards to protect user and patient information. No Protected Health Information (PHI) is stored or transmitted without authorization in compliance with applicable legal frameworks. Where MYOPHYSX, LLC. acts as a Business Associate, Business Associate Agreements are executed, and required safeguards are applied. Otherwise, users must avoid entering PHI unless a compliant pathway is explicitly provided. MYOPHYSX, LLC. maintains cybersecurity controls appropriate for health-related applications, including vulnerability reporting, protection against data poisoning, and incident response procedures with user notification when required.

5.6 Ethical Use, Bias Mitigation, and Misinformation Prevention
In alignment with AMA Policy H-480.935, MYOPHYSX, LLC. prohibits the creation or dissemination of false, misleading, or AI-generated misinformation related to medical or health content. All AI-supported educational materials undergo review to ensure accuracy, reliability, and adherence to scientific and ethical standards. MYOPHYSX, LLC. actively monitors for algorithmic bias and performance drift, suspending or correcting features that could introduce or exacerbate health disparities. This includes addressing potential inaccuracies or fabricated outputs (“hallucinations”) in generative content and removing or correcting them upon identification.

5.7 Limitations of Liability
To the maximum extent permitted by law, MYOPHYSX, LLC. and its affiliates shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from reliance on AI-generated outputs. Users remain solely responsible for clinical decisions, professional actions, and adherence to medical ethics and licensing requirements.
